Terms of Use

These Terms of Use govern your access to and use of the Percus platform, including the Backoffice application and any related services provided by Percus SpA ("Percus", "we", "us").
By accessing or using the platform, you agree to these terms. If you do not agree, do not use the platform.
1. Access and accounts
Access to the Percus platform is granted by invitation only. You must be invited by an authorized administrator of your organization. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
You agree to:
- Use only your own authorized Google account to log in
- Notify Percus immediately if you suspect unauthorized access to your account
- Not share your access credentials or session with others
2. Permitted use
The platform is provided exclusively for legitimate business purposes within your organization. You may use the platform to:
- Manage personalized video campaigns and templates
- Distribute video content through authorized channels
- Access analytics and reporting related to your organization's campaigns
- Integrate Percus services into your own systems via the provided APIs
3. Prohibited use
You may not:
- Use the platform in violation of any applicable law or regulation
- Attempt to gain unauthorized access to any part of the platform or another organization's data
- Reverse engineer, decompile, or attempt to extract source code from the platform
- Upload content that is unlawful, harmful, or infringes third-party intellectual property rights
- Use the platform to transmit malware, spam, or any harmful code
- Resell or sublicense access to the platform without prior written authorization from Percus
4. Data and content
You retain ownership of all content and data you upload to the platform (templates, campaign data, assets). By uploading content, you grant Percus a limited license to store, process, and serve that content solely for the purpose of providing the platform services to you.
You are solely responsible for ensuring that the content you upload and the personalization data you process through the platform complies with applicable laws, including data protection regulations.
5. Service availability
Percus will make reasonable efforts to maintain platform availability. However, we do not guarantee uninterrupted access. The platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
6. Intellectual property
The Percus platform, including its software, design, and documentation, is the intellectual property of Percus SpA. Nothing in these terms transfers any ownership rights to you.
7. Limitation of liability
To the maximum extent permitted by applicable law, Percus shall not be liable for indirect, incidental, special, or consequential damages arising from your use of or inability to use the platform.
8. Termination
Percus may suspend or terminate your access to the platform if you violate these terms or if required by law. Your organization administrator may also remove your access at any time.
9. Changes to these terms
We may update these Terms of Use from time to time. Material changes will be communicated through the platform. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.
10. Governing law
These terms are governed by the laws of the Republic of Chile. Any disputes arising from these terms shall be subject to the jurisdiction of the courts of Santiago, Chile.
